Terms of Service

Effective 2026-11-05 · Last updated 2026-11-05

These Terms of Service (“Terms”) are an agreement between Spidyhost IT Services Pvt Ltd (“BlazingNodes”, “we”, “us”) and the business or person using our service (“you”). BlazingNodes is a brand of Spidyhost IT Services Pvt Ltd.

By creating an API key, sending a request, or reaching our models through a marketplace, you agree to these Terms, to our Privacy Policy and to our Acceptable Use Policy. If you accept on behalf of a company, you confirm that you are authorized to bind it.

1. The service

We run open-weight AI models on GPU servers and give access to them through an OpenAI-compatible API (the “Service”). The models we offer, their quantization (for example FP8), their context limits and their prices are listed on our website and in our models endpoint.

2. Ways to use the Service

  • Directly: with an API key we issue to you.
  • Through a marketplace: platforms such as OpenRouter buy inference from us and resell it to their users. In that case:
    • the marketplace is our customer and pays us;
    • your relationship as an end user is with the marketplace, under its terms;
    • our Acceptable Use Policy still applies to all traffic we serve.

3. Accounts and API keys

  • Keep your API keys secret. You are responsible for all usage under your keys until you tell us a key is compromised and we disable it.
  • Do not share, sell or publish keys, except as a marketplace authorized by a written agreement with us.
  • You must give us accurate business and billing details, and keep them up to date.

4. Prices, billing and payment

  • Prices are per million tokens, separately for input tokens, cached input tokens and output tokens, as shown on our website or models endpoint at the time of each request. We may change prices at any time. A change applies to requests made after it is published, unless a written agreement says otherwise.
  • Measurement: charges are based on the token counts our service reports for each request, which are returned in each API response. If you believe a count is wrong, tell us within 30 days of the invoice.
  • Invoicing: unless we agree otherwise, we invoice monthly in arrears for the previous month’s usage. Invoices are due within 15 days.
  • Prepaid credit: if we agree to prepaid credit instead, usage is deducted from your balance and requests may be refused when it runs out.
  • Taxes: prices exclude taxes (for example GST), which we add where the law requires.
  • Late payment: if payment is late, we may suspend access after giving notice.

5. Your content and outputs

  • Inputs and outputs are yours. As between you and us, you keep all rights in what you send to the Service (“Inputs”). To the extent the law allows, you own what the models produce for you (“Outputs”). We claim no rights in either.
  • What we do with them: we process Inputs and Outputs only to provide the Service. As our Privacy Policy explains, we do not store them and never use them for training.
  • Your responsibility: you are responsible for your Inputs, and for how you use Outputs. You must have the rights needed for your Inputs.
  • Model licenses: each model is published by its creator under its own license, for example Apache-2.0. Some licenses include use restrictions. By using a model through our Service, you agree to follow its license terms, which we list on our models page.
  • AI limitations: models can produce inaccurate, incomplete, offensive or biased Outputs. Check Outputs before relying on them, and do not use them as the sole basis for decisions with legal or similarly significant effects on people.

6. Acceptable use

You must follow our Acceptable Use Policy. We may refuse, rate-limit or suspend traffic that breaks it, as section 9 explains.

7. Availability and changes

  • We aim for high availability, but unless a separate written agreement gives you a service level, we do not guarantee any uptime or speed.
  • We may return “429 Too Many Requests” when the Service is at capacity. Clients should retry or fall back.
  • We may add, change or retire models. Where we can, we give at least 14 days’ notice before retiring a model, through our models endpoint (deprecation date) and website.
  • We may carry out maintenance, and will try to keep it short and announce it on our status page.

8. Confidentiality

Each party will keep confidential any non-public information it receives from the other in connection with the Service, such as pricing terms, security details and account information. Each will use that information only to perform these Terms. This does not cover information that is public, already known to the recipient, or must be disclosed by law.

9. Suspension and termination

  • By you: you can stop using the Service at any time.
  • By us, on notice: we may end these Terms with 30 days’ notice.
  • By us, immediately: we may suspend or end your access straight away if you seriously or repeatedly break these Terms or the Acceptable Use Policy, fail to pay, or if your use threatens the security, stability or legal standing of the Service.
  • After termination: you must pay for usage up to the end date. Sections 4, 5, 8 and 10–14 continue to apply.

10. Disclaimer

The Service and all Outputs are provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.

11. Limitation of liability

To the fullest extent the law allows:

  • neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill;
  • our total liability arising out of or relating to these Terms is limited to the amounts you paid us for the Service in the 3 months before the event giving rise to the claim.

These limits do not apply where the law does not allow them to be limited, or to your payment obligations.

12. Indemnity

You will defend and indemnify us against third-party claims arising from your Inputs, your use of Outputs, or your breach of these Terms or the Acceptable Use Policy.

13. Governing law and disputes

  • Governing law: these Terms are governed by the laws of India.
  • Resolving disputes: the parties will first try to resolve any dispute in good faith. If that fails, the courts of India have exclusive jurisdiction.

14. General

  • Changes: we may update these Terms by posting a new version with a new date. For direct customers and marketplace partners, material changes take effect 30 days after notice. Using the Service after that accepts them.
  • Entire agreement: these Terms, the Privacy Policy and the Acceptable Use Policy are the whole agreement on their subject. A signed written agreement prevails where it conflicts with them.
  • Assignment: you may not assign these Terms without our consent. We may assign them to an affiliate or a successor of our business.
  • Force majeure: neither party is responsible for delays caused by events beyond its reasonable control, such as outages at our cloud providers.
  • Severability: if any part of these Terms is unenforceable, the rest stays in effect.
